These Terms of Use (“Terms”) govern your access to and use of the ProTuneFiles website (protunefiles.com) and the ProTuneFiles application (app.protunefiles.com) operated by V-Tuning. By creating an account, accessing the platform, uploading files, or using any services provided by ProTuneFiles (“PTF”), you agree to these Terms. If you do not agree, you must cease using the platform immediately.

1. General Information

  1. ProTuneFiles (PTF) is an online platform providing automatic and manual ECU/TCU file modification services using AI-based algorithms and/or expert manual tuning.
  2. The platform is intended for professional users, workshops, tuners, and businesses familiar with ECU/TCU programming.
  3. All services are performed based on the information and files provided by the user. PTF is not responsible for incorrect or incomplete data supplied by the user.

2. User Responsibilities

By using the platform, you confirm that:

  • You have the legal right to read, modify, and write software to the ECU/TCU of the vehicle associated with the file you upload.
  • You understand the risks associated with ECU/TCU tuning and vehicle modification.
  • You will not use the platform for any illegal, fraudulent, or harmful activities.
  • You are solely responsible for:
    • the hardware tools used for reading/writing the ECU/TCU,
    • procedures performed on the vehicle,
    • ensuring the vehicle is mechanically sound and safe for tuning,
    • verifying the final results.

3. Uploading Files

  1. The user is responsible for ensuring that uploaded files are:
    • correct and complete reads from the ECU/TCU,
    • free of corruption, encryption, or external modifications,
    • compatible with recognized reading tools.
  2. Incorrect or damaged files may be rejected by the system or result in processing errors.

4. AI Processing and Limitations

  1. If the platform detects a supported model, the file may be processed automatically using trained AI algorithms.
  2. AI may not support every ECU/TCU type or every service.
  3. The platform may suggest switching to Manual File Service if the file is:
    • unsupported by the AI model,
    • significantly modified,
    • from an uncommon or rare ECU type,
    • not meeting the requirements for automated processing.
  4. AI results are generated based on known map structures and calibration data but must always be verified by the user before flashing.

5. Manual File Service

  1. Manual processing is performed by professional tuners.
  2. Delivery times and availability may vary depending on workload.
  3. Manual services are billed according to the service price list.
  4. The user may be asked to provide additional information such as logs, datalogs, hardware modifications, or vehicle symptoms if necessary.

6. Service Pricing and Payments

  1. All prices displayed in the application are according to the service price list.
  2. Payment is required before processing begins unless otherwise agreed.
  3. User credit, tokens, or balances are non-transferable and non-refundable unless required by law.

7. Delivery of Modified Files

  1. Processed files (AI or manual) are delivered through the user panel at app.protunefiles.com.
  2. The user is responsible for:
    • verifying the content before flashing,
    • using correct flashing tools and procedures,
    • ensuring the vehicle is in proper mechanical condition.
  3. PTF is not responsible for:
    • incorrect flashing procedures,
    • poor vehicle condition,
    • hardware failures,
    • tool malfunctions,
    • user error.

8. Safety & Vehicle Condition

  • The user must ensure that the vehicle is fully operational and safe before performing any tuning.
  • PTF does not diagnose mechanical problems and is not responsible for:
    • pre-existing engine issues,
    • turbocharger or injector problems,
    • emissions component failures,
    • wear-related failures,
    • improper modifications.
  • If a problem occurs after flashing, it does not automatically indicate a file issue.

9. Revisions, Fixes, and Adjustments

  1. If the delivered file does not perform as expected, PTF may review the case.
  2. Additional information (logs, descriptions, parameters, scans) may be required.
  3. Fixes are provided when:
    • the issue is caused by the delivered file,
    • sufficient evidence is provided,
    • the fault is not related to vehicle condition or user actions.
  4. Adjustments beyond the originally purchased service may require an additional fee.

10. Refund Policy

Refunds may be issued only when:

  • The file cannot be processed by PTF (AI and manual both unavailable).
  • A service was purchased but cannot be delivered for technical reasons.
  • The user purchased a service by mistake and has not yet uploaded or processed a file.

Refunds will not be issued for:

  • vehicle mechanical issues,
  • unsuccessful flashing due to user error,
  • incorrect file uploads,
  • attempts to modify unsupported ECUs not listed in the application,
  • services that were already completed.

11. File Storage and Privacy

  1. Uploaded files may be stored for internal quality, training, diagnostic, or verification purposes.
  2. PTF does not share files with third parties unless required by law.
  3. User account information is stored securely and processed according to privacy regulations.

12. Account Suspension or Termination

PTF reserves the right to suspend or terminate accounts that:

  • violate these Terms,
  • abuse the system,
  • attempt to manipulate AI models, pricing, or file delivery,
  • engage in fraud or illegal activity.

13. Intellectual Property

All AI models, algorithms, manual tuning procedures, and platform infrastructure belong to V-Tuning. Users may not attempt to reverse-engineer, duplicate, or extract internal logic from the platform.

14. Liability

PTF is not liable for:

  • any damages resulting from flashing files,
  • engine, transmission, or hardware failures,
  • indirect, incidental, or consequential damages,
  • loss of revenue or downtime.

The user accepts full responsibility for tuning activities.

15. Modifications to Terms

PTF may update these Terms at any time. Continued use of the platform constitutes acceptance of the updated Terms.
